Company Law

The Company Law was promulgated and published in the UAE Official Gazette on 1st April, 1984 known as the Law No. 8 of 1984 which was later on amended by Law No. 13 of 1988 and Law No. 15 of 1988. This Federal Statute is applicable to all the seven (7) emirate members that constitute UAE. The main primary considerations of this law are to regulate the formation and functioning of the different types of juridical commercial personalities that are accepted to be registered in the proper authorities as companies in the United Arab Emirates.

Labour Law

Labour issues in the UAE are governed by Federal Law No. 8 of 1980 as amended by Federal Laws No. 24 of 1981, No. 15 of 1985 and No. 12 of 1986. The main purposes of the promulgation of such law are to ensure fair treatment between employers and employees, provide basic rights and obligations including procedures and ways of mediation and settlement of labour dispute and to foster harmonious relationship amongst the employer, the employees, the Government and the society.

Intellectual Property Law

United Arab Emirates promulgated Federal Law No. 40 of 1992 that aims for the protection of the legal property rights over the owner’s creations such as Books, booklets and other written matters, works given verbally as lectures, speeches and sermons, dramatic and musical plays, musical works whether accompanied by words or not, the works of designing eurhythmics and pantomime etc. Under such law, owners are granted certain exclusive rights of their creation. Common types of intellectual property include copyrights, trademarks, patents, industrial design rights and trade secrets.

Property and Real Estate Law

Real estate business and investment in the United Arab Emirates is one of the income generating sectors that create a big impact in UAE’s economic situation. Federal Statute, Circulars, Memorandums and Issuances by each of member that constitutes UAE are promulgated for the regulation and protection of the key players in the Real Estate business such as the investors, brokers, sub-developers and main developers. Some notable laws like Free Hold Properties, Landlord-Tenant Relationship, Real Estate Register, Mortgage of Real Properties, Rent Index etc. are strictly implemented by proper authorities.

Construction Law

Several Federal statutes, decrees and issuances are applicable with matters relating to legal disputes or issues relating to constructions and its related fields such as UAE Civil Law No. 2 of 1987 relating to construction works and its legal maxims, laws and decrees issued by the Emirate of Dubai relating to contracts with the Government, Civil Procedure Law No. 11 of 1992, Federal Building Code, FIDIC etc. These laws and decrees covers, protects and regulate the key players in the construction industry, including the engineers, developers, consultants, architects, workers, planners, financial institutions etc. Disputes pertaining to construction are generally submitted to expert committee for the proper resolution of the issues and matters involved.

Business Investment Law

UAE Foreign Investment Law is a law designed to make foreign investors to invest in the country. This law will regulate the incoming foreign investment into the UAE that will facilitate greater inflow of foreign capital that encourage foreign investors to start-up companies and businesses in UAE.

Aviation Law

The General Civil Aviation Authority promulgates rules and regulations in coordination with proper authorities pertaining to all civil aviation such as but not limited to aircraft registration and certificates, implementation of international agreements and treaties in the field of Civil Aviation, airworthiness, rules pertaining to flight over the territory of the State, landing and departing from airports especially the conditions of carriage of passengers and cargoes, determination of aerial navigation, enforcement of international standards in aviation etc.

Land Transportation Law/Traffic Law

UAE is geared up to the strict implementation of traffic rules and regulations. Penalties of violations of such traffic rules and regulations are ranging from a fine of Five Hundred (500 AED) to Five Thousand Dirhams (5,000 AED) and imprisonment, hence, by these stiff penalties road mishap would probably be avoided

Damages and compensations

Under the several provisions of the Federal Law No. 5 of 1985, the Civil Code of UAE, a tort is a civil wrong resulting from an act or omission that has caused injury or loss of person or damage to property notwithstanding such act or omission constitutes a crime or cause by breach of a contractual obligation.

Immigration Law

It refers to the Federal policies that govern the immigration, visa types and permits and its requirements to enter the jurisdiction of the United Arab Emirates. The provisions and the requirements provided by this law regulate the right of entry and internal rights and obligations once inside the jurisdiction of UAE including the duration of stay, penalties of overstaying, amnesty programs, undesirable expatriates etc.

Sharia Law

A legal framework for Muslims within which the aspects of life are regulated based on the Islamic religious law. This law regulates relationship of the family, inheritance, marriage, sexuality, hygiene, economics, politics, business and social issues of the Muslims.

International Law

The United Arab Emirates adhere to the strict observance of international relations as party to international and bilateral treaties. UAE became a member of the United Nations sometime 9 December 1971. International Law can refer to three legal disciplines: Public International Law which involves UAE and other international organizations, maritime law, international criminal law and Geneva conventions, including trade agreements. Private International Law refers to the conflict of laws such as legal jurisdiction may a case be heard and the law concerning which jurisdiction apply to the issues in the case.

Banking Law

Several types of banking system that are presently working within the United Emirates such as commercial banking, Islamic banking, investment banking, retail banking and other types of banking. These all banking systems and activities are regulated by the Central Bank of the United Arab Emirates. Numerous laws, circulars and regulations were promulgated to achieve, promote and protect banking transactions and activities of financial institutions in UAE.

Maritime Law

The UAE Federal Law No. 26 of 1981 otherwise known as the Maritime Code of the United Arab Emirates governs and regulates all shipping activities in the UAE such as but not limited to registration of vessels, mortgage of vessel, chartering of vessel, marine insurance, salvage of vessels etc. The promulgation of this law is in conformity with international law and maritime international conventions and agreements.

Criminal Law

Criminal Law is a body of laws that define crimes or offense and its punishment. UAE has several criminal punishments depending of the offense that the criminal has committed. Criminal cases are given more preference over other cases to have a speedy disposition or decision of the case. Criminal law is strictly enforced by the Government of UAE

Commercial Law

Federal Law No. 18 of 1993 otherwise known as the Commercial Transaction Law of UAE is the main law pertaining to trade and commerce activities. In this law, the obligations of the traders, prohibited and non-allowable transactions, unfair practices and penalties are clearly defined. Specified therein also is the proper government authority to implement the provisions of this law.

Civil Law

Civil Law is that branch of law which deals the dispute between individuals and organizations in which civil penalties or compensation will be awarded to the injured individual. Civil Law is a very large embracing law that almost covers all dispute which is not a criminal action such as collection or recovery of debt, preference of credit, property disputes etc.
